WTO与中国法制现代化

WTO对中国最深层次的影响是法律,影响有消极与积极之分。其对中国法制现代化将产生的积极作用主要表现在:有利于中国法制观念、意识、理念的现代化,加速中国的行政法制现代化,对中国法治本土资源的消极方面带来冲击等。其消极影响表现在:如果不加选择而盲目全盘吸收WTO及其发达国家成员国的法律,则会影响中国法律发展的正常进程,导致混乱。因此,对于WTO这把双刃剑要有清醒的认识,尽量做到法律领域的趋利避害,从而加速中国法制现代化进程。

WTO AND LAW MODERNIZATION

The most deep effecting of WTO to china is law. And there will be two sides of the effect,one is good,the other is bad.The good effect are as follows: WTO will benefit or accelerate the modernization of law idea.It will also accelerate the modernization of china's administrative law and remove the bad sides of china's tradition. The bad sides of WTO also exist. If we comply the rules of WTO without selecting, it may be harmful to our law modernization. So it is important for us to be cautious.
