| 摘 要： | 文章通过分析我国单位犯罪现有处罚制度上的缺陷,特别是单一的罚金刑制度无法达到处罚和预防单位犯罪的刑罚目的,来论证改革罚金刑和增设单位资格刑的必要性。其次,提出了完善单位犯罪处罚制度的立法建议,如改革现有罚金刑,增设限制单位营业活动,取消单位营业资格等针对单位犯罪的资格刑。

| Abstract: | First,this paper through the analysis of existing defects of punishment system in our unit crime,especially single penalty punishment system cannot reach the prevention purpose,to demonstrate the reform of penalty punishment and additional units' crime.Secondly,it puts forward several suggestions on improving the unit crime punishment system such as the reform of fine penalty punishment,addditional of restrictions of business activities,cancelling qualification of unit's business activities. |
