| 摘 要： | 我国现行法律规定,农村集体土地的所有权主体为一定范围内的＂农民集体＂,但由于目前我国立法上的缺陷,出现了农村集体土地所有权＂主体缺位＂的问题。因此需要按照法人治理模式,构建农村集体土地所有权主体,赋予＂农民集体＂的法人资格,还农村集体土地所有权主体本来面目。

| Abstract: | According to the stipulation of the present laws,the subject of the collective ownership of land is to some extent the farmer collective.For the flaws of the present laws,the problem of the absence of the subject comes up.A corporate model,for the establishment of the subject of rural collective land ownership,providing ＂farmers collective＂ with a status of corporate body with a reasonable and practical system design can help solve the problem. |
