| 摘 要： | 公诉案件的撤诉符合控审分离原则和起诉便宜主义的要求,体现了保障人权的价值追求和诉讼经济原则;撤诉应遵循一定的程序,应在法律辩论终结前提出并说明理由;法院应当对检察机关的撤诉申请进行司法审查,听取被告人质疑意见;公诉机关撤诉后诉讼程序终止,不得再行起诉。

| Abstract: | The withdrawal of public prosecuting is not only in line with the requirements of the principle of the separating of prosecuting and adjudicating and that of the freedom in prosecuting, but also embodies the pursuit of protect ing human right and efficiency. Withdrawing a case should be before the end of d efence in court. The prosecution organ should explain the reason for withdrawl; the court should conduct judicial review on cases for which the prosecution orga n ask to withdraw; meanwhile, take the opinions of the defendant and the victim into consideration.After withdrawal, the criminal procedure is over and the proc uratorate can not prosecute once again |
