| 摘 要： | 民间合约是清代徽州人处理纷争时惯用而有效的方式,在乡村治理中占据着独特位置。徽州地狭人众,围绕土地、山林和坟地等资源发生的纠纷较多,人们常常通过订立"封禁合约"来保护自身的利益。当发生犯禁事件,且事态并不严重时,让犯禁者写立"甘服合约"是解决纠纷的重要方式。当诉讼不可避免时,提起诉讼的事主们往往会订立"诉讼合约",明确各人在诉讼中的责任。诉讼过程中,双方当事人往往又会寻求和解,订立"息讼合约"。从徽州民间解决纠纷的方式上可以看出,在国家法控制架构内,民间合约是协助封建国家权力和法律有效治理乡村社会的一种重要形式。

| Abstract: | Taking the forbidden zones of land,mountain forests and burial ground as clues,this paper introduces and analyses how Huzhou people dealt with these disputes and the agreements appeared in different stages.It holds that civilian agreements were habitual and effective ways for Huizhou people to solve their problems in the Qing Dynasty and palced an important role in country government.They worked as important assistants for state power and laws to gover rural community under the framework of national laws. |
