| 摘 要： | 我国宪法规定,为了公共利益的需要,可以对公民私有财产和土地进行征用与征收。由于"公共利益"的界定一直未有定论,故往往导致征用过滥而损害公民利益。美国司法实践中,对于发展中的公共利益,多采用逐例的方法进行判断,这对我们今天准确把握公共利益有着良好的借鉴意义。

| Abstract: | "Public Interest" exist in our Constitution ,but the blurry definition of the concept "Public Interest" leads to the deviation of many administrative taking behaviors.We study the justice practice of United States and find out that the way for judgment of "Public Interest" is based upon the "Case by Case" method.It will provides us with reference to grasp the true meaning of "Public Interest". |
