论我国传统诉讼文化中的刑名师爷

我们无法摆脱传统诉讼文化对当下法治建设的影响。乡土社会中的刑名师爷是案件的真正决断者,是法律职业者,但他们的社会地位十分低下,处于政治和道德上被双重拒绝的困境,这恰与发轫于西方的现代法治理念和现实形成鲜明的对比。借古思今,以制度化的方式提升法律职业者的地位,仍然是我们努力的方向。
