民族自治地方变通执行与停止执行法律问题探析

民族自治地方变通执行与停止执行上级国家机关的决议、决定、命令和指示是行使自治权的一种形式。它在特定情形下具有立法权的性质，但变通执行或者停止执行主要发生于国家机关的行政执法过程中，更多地体现为一种行政管理方面的自治权。为使该规定得以更好地贯彻实施，需要进一步规范和完善权力行使的主体、程序、方式与步骤。《民族区域自治法》未赋予民族自治地方司法解释及司法机关规范性文件的变通执行或停止执行权，法律的变通在特定情形下就失去了意义。建议《民族区域自治法》修改时，明确规定民族自治地方可以依法定程序对司法解释变通执行或停止执行。

A Study of Implement with Certain Alterations or Cease Implementing in National Autonomous Areas of China

If a resolution, decision, order or instruction of a State organ at a higher level does not suit the conditions in a national autonomous area, the organ of self-government of the area may either implement it with certain alterations or cease implementing it. In a particular case, it has the nature of legislation. It usually occurs in the administrative enforcement process and it＇ s mainly the power of administrative autonomy. In order to exercise the power properly, the principal, procedures, methods and steps should be rearranged and perfected. Autonomous regions are not granted the power to implement judicial interpretation with certain alterations or cease implementing it in Regional National Autonomy Law. Therefore, it is suggested that it should be clearly defined when Regional National Autonomy Law is revised.
