| 摘 要： | 网民发动"人肉搜索"的目的不只为了获取当事人的有关信息,而是要通过对搜索对象真实信息的揭露,来表达意见、态度和情绪.因此,"人肉搜索"在本质上不过是一种舆论表达,是网络舆论的一种形式.对于"人肉搜索"的规制,必须处理好个人隐私与言论自由、个人利益与公共利益的平衡,必须考虑社会核心价值的维护和道德评判的标准.
