| 摘 要： | 《物权法(草案)》自2005年7月公开征求意见以来,就备受社会各界的关注,尤其是法律学者之间的争议非常大。自2005年底以来,关于《物权法(草案)》的争论有升级的趋势,似乎上升到了政治与意识形态的高度。物权立法要从中国国情出发,法律学者要适应时代的发展,立足于中国实际,为制订出中国特色的物权法作出自己的贡献,真正履行好学者的责任。

| Abstract: | "Real Right Law(Draft)" has been widely concerned by the literati of laws and even the public.The hot discussion becomes controversy and it even upgrates to a oral battle concerning about politics and ideology.The legislation on "Real Right Law(Draft)" should be based on the reality of our nation and law literati also should adapt their thoughts to the development of the time,take their responsibility in legislation. |
