| 摘 要： | 德国历史法学派与近代法学方法论的创始者萨维尼之所以反对在当时立法,并非完全基于＂民族精神＂说。《论立法和法学的当代使命》的伟大之处,恰恰是在法律语言下隐藏着更高远的智慧：一个统一的私法法域有利于推进国家统一;但当这个私法法域还未真正形成时,如果草率立法反而有可能造成孕育中的统一法域的分裂。

| Abstract: | Friedrich Carl von Savigny, the founder of the historical school of law, opposed codification at that time not necessarily because of his theory of ＂national spirit＂. The greatness of Vorn Beruf unserer Zeit fiir Gesetzgebung und Rechtswissenschaft lies in the profound wisdom behind its legal language： a unified scope of private law will promote the unification of the nation; yet before such a scope comes into being, careless codification may result in the break-up of a unified law scope that is in formation. |
