实践视域下公立高校教师聘任制合同的法律性质

随着我国教育体制改革的发展,公立高校的教师任用制度已由传统的任命制转为现代的聘任制。教师聘任合同究竟是属于行政合同还是劳动合同,由于立法并未给予明确规定,因此在学界一直争论不休。笔者在对聘任制实施现状分析的基础上认为:在现有人事财政体制、社会保障机制及相关教师制度基础上,教师聘任合同具有行政合同的法律性质。

The nature of the engagement contract of teachers in the light of public universities

With the development of the reform of the educational system in China, the employment of the teaching staff in the public universities has changed from the traditional appointment system to the modern engagement system.The legislation does not specify the nature of the contract of engagement.Based on the analysis of the current conditions of the engagement system,the author concludes that on the basis of current personnel financial system,social security system and other related systems concerning the profession of teachers,the contract of the engagement of teachers is of the nature of administrative contract.
