| 摘 要： | 情势变更原则授予合同中受情势变更影响的一方当事人合同变更权 ;外国 (地区 )法律中有的规定该当事人对它可以直接行使 ,有的规定其对它只能通过司法程序行使 ,有的规定它的行使对象仅限于数量条款 ,有的规定变更权行使对象为合同全部条款。外国 (地区 )法学界有人认为该变更权是一项虽符合公平要求但对社会经济秩序不利的合同权利 ;有人认为应将经变更后的合同内容对双方当事人均显得公平确定为这一权利的行使条件 ;有人认为由它的行使所体现的效力只是情势变更原则的第一次效力 ;笔者认为该变更权在性质上属于形成权 ,它的出现对大陆法系合同法理论中的合同定义的正确性提出了挑战。

| Abstract: | In accordance with the mathematics philosophy,a party influenced by the mathematics is vested with the right of modification of contract.In field of law abroad,there are various ideas and stipulations about the nature and exercise of the right.The author points out that modification right,in its nature,is right in formation,and it challenges the correctness of the definition of contract in the theory of contract law in civil system. |
