摘    要:我国有必要在担保法或民法典债的担保方式部分 ,以“让与担保”的名称统一规定让与担保和按揭制度 ,而不宜将让与担保作为一种担保物权规定在物权法中 ,理由是 :让与担保既有物权性质又有债权性质 ;作为物权规定 ,其公示方式问题无法解决 ;现行担保法禁止流质契约。

Abstract:According to Chinese practice, transferring guarantee and mortgage should be stipulated coherently as " transferring guarantee" in the Guarantee Law or in the part of the guaranteeing methods of obligation of the Civil Code; Transferring guarantee should not be regarded as property characterized right in the property law because of its complexity of characters, and it's difficult to choose the methods of public announcement, and in current mortgage law, "fluidity contract" was prohibited, so we should set up " transferring guarantee".
