网络视频侵权研究

自2006年步入发展元年始，中国网络视频行业已经走过了3个多年头。在短暂的3年多中，网络视频取得了长足进步，用户覆盖和影响力不断提升，但网络视频的侵权问题始终阻碍着网络视频行业的蓬勃发展。本文试图通过对各种侵权案件类型的梳理来对侵权的归责原则进行分析，从而提出针对不同类型侵权所应适用的法律原则和规则，以寻求版权保护与视频网络视频发展之间平衡的途径。

A Study of Network Video

From the year of 2006, the network video has been developed and strengthened increasingly over three years in China. In this short period, the network video has developed remarkably. More people have used this video and its influence is expanding. However, the problem of copyright infringement related to the network video has hindered its quick development. The present paper intends to classify the types of infringement cases and analyze the doctrine of liability fixation in different infringement cases, based on which it tries to propose some kinds of legal principles and rules in order to find out certain ways to balance the relationship of copyright protection and the development of network video.
