民族的文化与现代中国法的精神

法是一种文化现象,作为整体的民族文化的一部分,它寄身于民族文化之中。一个民族的文化孕育了它的法和法的精神,法和法的精神深深地植根于民族文化。因此法的精神主要应当从其文化中去发现或寻找并获得理解。当代中国正处于由传统向现代的社会转型之中,其文化尚未充分整合并定型,真正现代意义的民族文化也尚未形成。

National Culture and the Spirit of Modern Chinese Law

Law is a cultural phenomenon. As a part of national culture, it exists in national culture. A nation's culture gives birth to its law and legislative spirit which is deeply rooted in the national culture. So legislative spirit should be discovered and understood from its culture. During the period from traditional to modern society, China's culture has not been completely integrated and fixed, a national culture with real modern meaning has not formed.
