| 摘 要： | 现在法哲学思想界对法哲学的学科性质歧见很大,有着各不相同的“法哲学”观。所谓法哲学,其实质就是法的形而上学,它是关于法(律)现象的抽象本质和存在根据的学说。其他诸种“法哲学”观均有悖于法哲学的一般本质,都是非哲学的“法哲学”观,不足以称之为法哲学。

| Abstract: | Views about “law philosophy” are different regarding the nature of this branch of learning.This article points out:the essence of law philosophy is the metaphysics of law.It is the doctrine on the abstract nature of and the foundation for the existence of law phenomena.The various kinds of “law philosophy” views other than this are all against such an understanding of the general nature of law philosophy,therefore they are non-philosophical views of “law philosophy.” |
