| 摘 要： | 安乐死是当前法学、伦理学界的共同难题.作者从三维取向的生物-心理-社会现代医学模式出发,探讨了安乐死的法律与伦理学问题,认为单纯的生物医学模式不可能导致安乐死的合法化,只有生物-心理-社会现代医学模式才可能指导和推动安乐死合法化进程.安乐死特别是被动安乐死以隐秘或半公开方式而存在,针对这一客观事实,依据现代医学模式,在实施安乐死过程中应遵循有利原则、自主原则、合法原则和公开原则等道德原则.

| Abstract: | Euthanasia is a thorny issue in the fields of law and ethics. This article deals with the legal and ethical aspects of euthanasia through the modem medical mode of the three dimensions of biology , psychology and society, drawing the conclusion that biological medical mode alone can not ensure the legalization of euthanasia and that only the modern medical mode of the combination of biology, psychology and society can direct and promote the legalization of euthanasia. Considering the fact that Euthanasia, passive euthanasia in particular, exists secretly or semi-secretly, we should, according to the modem medical mode, apply the moral principle of Beneficence, Self-determination , Legality, and Justice in the realization of euthanasia. |
