| 摘 要： | 随着我国农村经济体制改革的推进，股份合作制组织对农村村民自治组织及其运作、对村民一公民身份及其权利的确认和法律保护、对股份合作制企业与各种企业形式的法律冲突、对股份合作制企业内部组织和运作程序，对股份合作制企业的过渡性质等等，都带了诸多现实问题和法律问题。通过解剖个案并提出解决办法，对于完善相关法律体制，具有重要理论价值和现实意义。

| Abstract: | In China＇s reform of rural economic system, joint-stock cooperative enterprises have no law for reference. A case study shows the conflict of this kind of enterprise with various enterprise laws in present China. This paper discusses its internal organization and working mechanism, its transitional nature, and its impact on villagers＇ self-government law. It also deals with the confirmation and legal protection of the villager-citizen identity and his right, and the relationship between administrative management and enterprise operation. |
