| 摘 要： | 辩诉交易需要一系列的制度条件、司法理念支撑,我国的刑事诉讼制度、司法理念不足以满足辩诉交易的运作。因此,我们必须在改革、完善了与辩诉交易相配套一系列的诉讼制度、司法理念后,才能借鉴运用辩诉交易这柄双刃剑。

| Abstract: | Plea bargain requires a series of schematic conditions and judicial conceptions as premises, of which China's criminal procedures and judiciary is lack.So transplant of plea bargain into China's legal system asks for reformation and perfection of the coupling procedural schemes and legal conceptions, so as to make the best of this doubt-edged sword. |
