高校内部管理自治性与他律性的法律思考

在我国现行教育体制下,我国高等学校依法享有自主办学权、自主管理权,其管理具有一定的自治性和能动性。但是高校管理权同其他行政权力一样,具有天然的强制性和潜在的扩张性,如果不对其加以他律,即有效的监督和制约,就容易被滥用,就可能损害学校师生的合法权益,使学校陷入无序无为状态,所以在强调高校内部管理自治性时必须重视对它的他律性。

Thought on Law of Autonomy and Heteronomy of University Administration in China

Under the current education system, universities enjoy administrative power of autonomy and activity. But as other administrative power, if it was not controlled and supervised effectively, it would harm the legal rights of teachers and students. University would fall into a disorder situation. So it is necessary for university administration to think highly of heteronomy while emphasizing autonomy.
