对立法程序的哲学审视

立法程序是以法律的确定为目标连续发展的一个系统的过程。在它发展的每一个阶段、时期 ,其倾向性都是由占主导地位的内部因素、客观因素这些矛盾的主要方面所决定 ,并受到各种外部条件、主观因素的制约。从哲学的角度来考虑 ,立法过程实际上表现为主观与客观的互动、经验与理性的统一 ,内因与外因的合力。这些矛盾的不同方面都不可能是绝对的、排它的决定性因素 ,它们相互结合、相互依赖 ,从不同的角度影响着立法的进程。对立法程序的研究 ,就是对整个立法过程的一种外在因果性解释和内在规律性把握

Philosophical Observation on Legislative Procedure

Legislative procedure is a systematic process that aims at formulating a law. In its every stage,its trendency is determined by the inside and objective factors which are the principal aspects of contradictions,and is influenced by the outside and subjective factors.In the view of philosophy,legislative process manifests virtually the combination of subjectivity and objectivity,experience and rationality,and inside factors and outside factors,of course these contradictory elements couldn't be exclusive.They influence the legislative process from different angles.
