法律视阈下少数民族非物质文化遗产新型分类与保护范式-以新疆哈萨克族为例

少数民族非物质文化遗产整体性保护在现阶段不具备取得实效的条件，仍需对其进行单项分类式保护。非物质文化遗产现行学科分类及保护具有一定的局限性，给非物质文化遗产法律保护实践带来了较大困难，对非物质文化遗产从法律角度进行重新分类有利于法律保护。法律视阈下应以非物质文化遗产的生存状态和濒危程度为标准对其进行分类，并通过国家立法干预以及市场调节的方式进行相应的保护。

New Classification and Protection Pattern of Intangible Cultural Heritage of Ethnic Minorities- the Kazakh People in Xinjiang as an Example

An integrated protection of the intangible cultural heritage of ethnic minorities falls short of a successful effect now. It is still necessary to strengthen the single classified protection of intangible cultural heritage. The present classification and protection have limitations that have brought many difficulties to the practice of legal protection of intangible cultural heritage. A re-classification from the perspective of law is conducive to a legal protection of the heritage. Intangible cultural heritage should be classified according to its present condition and endangered degree and be protected through national legislation intervention and market adjustment mechanism.
