| 摘 要： | 司法审查是WTO规则得以有效实施的重要保障。中国政府已承诺建立与WTO规则相符合的司法审查制度。司法制度的构建有赖于司法理念的支撑。在WTO的全部法律文本中凝聚着一系列当代司法的基本理念,厘清这些司法理念,对于确立当代中国的司法理念,构建符合WTO规则的中国司法审查制度,进而使中国真正融入世界经济体系主流,具有重大的指导意义。

| Abstract: | The judicial review is the important safeguard to carry out effectively the WTO regulation.Chinese government has promised to establish the judicial review according to WTO.Establishing the judicial system must depend on the support of judicial ideas.There are a series of modern judicial ideas in all the WTO legal documents.To erect these ideas in modern China,to establish the judicial review system that WTO encourages, which makes China indeed take part in the global economic system,it is very important to recognize these ideas. |
