| 摘 要： | 排污权交易制度作为法律化的经济制度 ,最早规定于美国法律制度中。我国也开始局部实践。其经济理论根源于环境外部不经济性的内部化 ,其法律价值在于企业利益与社会利益、效率与公平的统一。
