Avoiding Guardianship

The lack of progress in guardianship reform during the last thirty years is described. The use of the living will and durable power of attorney is proposed as a more promising approach to elder autonomy than working within the present guardianship system. In spite of differences among the states and restrictions that limit the utility of the living will, it holds out more promise than guardianship as a legal tool of general application.
