| 摘 要： | 环境犯罪的侵害法益，首先存在着物本法益说与人本法益说的对立。因为这两种学说均存在一定的缺陷，就出现了尝试消除物本法益说与人本法益说对立的各种调和学说。实际上环境犯罪的侵害法益应该包括两类：一为生命、健康与财产；二为环境权。

| Abstract: | There is a theoretical conflict between mattercentered legal interest and hmnan - centered legal interest concerning legal interest infringement in environmental crime. Considering the limitations of the two theories, attempts have been made to establish a new framework mediating the clashing elements. Actually, it must be realized that legal interest infringement in environmental crime has two aspects： life and health and property, and environmental right. |
