| 摘 要： | 外层空间专利的国际保护关键在于国内法上对外层空间专利的承认与保护,而国际法上并不妨碍各国对于外层空间专利的保护,而且为外层空间专利的国际保护提供了现成的机制。文章认为,外空法一些具体的制度为外层空间专利的国际保护提供了更为专门而明确的帮助。但一些不具备探索和利用外层空间能力的国家依据是外空法中的
