| 摘 要： | 刑事政策是国家惩治与预防犯罪的准则和措施，可分为基本的刑事政策与具体的刑事政策两种。通过历史考察，我国基本的刑事政策经历了由单纯功利主义向功利主义与人本主义相结合的转变。宽严相济刑事政策是和谐社会的内在要求和保障，应在刑事立法、刑事司法以及刑事执行各个阶段发挥宽严相济刑事政策的指导作用。

| Abstract: | General and Specific Criminal Policy are the national criteria and measures to prevent and punish crimes. History has witnessed a transition of general Criminal Policy in China from utilitarianism to an integration of humanism and utilitarianism. Combining Punishment with Leniency is an inherent requirement and guarantee of a harmonious society and shall play a guiding role in different phases of criminal legislation, justice and execution. |
