| 摘 要： | 本文通过对理论界有关集体土地所有权法律性质的几种学说进行客观评析，本着判断一种学说是否科学、合理，则要看它是否能促进农村生产力的发展，维护农民的切身利益的标准，认为集体土地所有权的法律性质是一种新型总有。

| Abstract: | This paper makes an objective assessment of several theories on the legal nature of collective land ownership. Based on the criteria that the correctness and feasibility of a theory lies in whether it can enhance the development of rural productivity and protect farmers＇ vital interests, the paper concludes that the legal nature of the collective land ownership of our country is a new collective total. |
