| 摘 要： | 我国《继承法》规定的法定继承制度,内容简单且不够全面。《继承法》应以我国《民法典》的制订为历史契机进行修订和补充,扩大法定继承人范围,增加法定继承顺序,强化配偶继承权的法律保护,完善代位继承制度等,以进一步完善我国的法定继承制度,并为《民法典》的制订打好基础。

| Abstract: | The contents on statutory succession provisioned by ＂Law of Succession of the People＇s Republic of China＂ are simple and not comprehensively covered,which calls for further collation and supplement in line with ＂Civil Code＂.The provisions about enlarging the scale of legal successors,adding legal inheritance order,reinforcing the protection of spouse＇s right to inheritance and improving the subrogation system,etc.should be included into the legal system of succession in China and pave the way to the establishment of ＂Civil Code＂. |
