法学翻译与法律现代化

中国法律的现代化进程已有百年历史,法学翻译对于中国法律的现代化有着极为重要的意义.首先,法学翻译对于中国现代法学具有建构与生成的意义,从法言法语到制度理念,均建立在法学翻译的基础之上;其次,法学翻译的发展轨迹,直接影响着中国现代法学的演进过程,从取法西洋、学习日本,转至模仿苏俄,进而重新面向世界,法学翻译的曲折变迁也印证着现代法学的艰难命运;第三,法学翻译对于现代法治国家的建构亦有重大影响,作为后发赶超型国家,译介移植是不可避免的过程,但也应有反思的态度和超越的决心.对近代以来中国法学翻译史的梳理和总结,一方面旨在较为全面概括地展示百年法学翻译的成果和历程,另一方面也可以借此观察到法学翻译与现代法学之间的深层次的内在关联和意义.
