| 摘 要： | 刑事诉讼制度与其赖以生存和发展的社会伦理环境密切关联：古代伦理道德体系与早期弹劾式诉讼制度，等级差序伦理观与传统纠问式诉讼制度，近代自然权利理论与辩论式诉讼制度保持着同构共生、动态衡生与网络整生的生态平衡关系。我国正在进行的司法改革与程序更新势必要求同步推进道德体系建设以保持二者的平衡互动。刑事诉讼制度的调整应与新型道德原则精神相协调，力促刑事诉讼法律系统与社会伦理环境保持生态平衡。

| Abstract: | There is a tight relationship between development and evolvement of the criminal procedure and its ethics system environment. Antiquity ethics system with traditional accusatorial criminal procedure, hierarchical valuable system with inquisitorial criminal procedure, neoteric natural right theory with modern accusatorial criminal procedure have maintained ecological balancing. Chinese judiciary reform and procedure updating demand consequentially to promote ethics system constructing in order to maintain ecological balancing and accelerate to develop harmoniously between them. |
