| 摘 要： | 英美法系国家刑事诉讼中施行已久的辩诉交易制度对缓减控辩双方的诉讼冲突、实现社会的法律控制方面起了巨大的作用。在分析研究的基础上 ,借鉴移植这一制度是现实的、可行的 ,它能带领我国正在进行的刑事诉讼制度改革走出困境。

| Abstract: | The Plea Bargain System , which has been executed for a long time in criminal proceedings , plays a very important role in mitigating conflict between the accuser and the defender , as well as realizing the social dominion of law . Based on analysis and study , the system of borrowing , transplant is realistic and feasible. So , it will lead our country out of difficulty in Criminal Proceedings System reform under way. |
