论中国古代法制史的伦理特色

中华法系作为世界五大法系的重要一支,其区别于世界其他法系的重要特征即中国古代法制的演化进程是以家族本位和义务本位为核心的道德伦理法律化过程.中华法系在当今世界法律体系中虽然已经消亡,但数千年里延续积累下来的中国古代封建法的这些伦理特征,在社会主义社会中仍然或多或少有所反映.在我国当前社会主义法制建设中,应当站在历史的高度,取其精华,弃其糟粕,克服这种不利的倾向,从而更好地推进依法治国的进程.
