| 摘 要： | 由于网络环境里的商业秘密的记录和存储方式有别于传统的物理空间的商业秘密的保存方式，因此，当网络环境里的商业秘密遭遇侵权时，权利人或被控方不仅要承担传统的物理空间里的证据种类的举证责任，还需承担信息社会里的一种新类型的证据——电子证据的举证责任。

| Abstract: | Since the recording and storage mode of the trade secret under the Internet environment is different from that in traditional physical space,when the infringement of trade secret under the Internet environment happens, the obligee and indictee must take the evidential burden of proof in traditional physical space,and at the same time,they must take the burden of proof for electronic evidence. |
