| 摘 要： | 当前，我国建构民族自治州立法机制中面临的困境：立法权源与层级的不对等造就立法的无序、上级机关审批程序的失范、部门利益、地方利益抬头，造就民族自治州立法实践中的种种非法治化倾向。扶持民族自治州优化地方立法机制要划定权限、明确职责、强化监督、同时也要尊重国情地情，有序地推进。

| Abstract: | Presently, the legislation troubles in the minority prefectures are seen in the following aspects:legislation dis-order caused by unequal legislation sources and levels; disorder examination from the upper level; department and local profit;and the improper legal practice. To support the legislation system in the minority prefectures, it' s necessary to clarify duty and reinforce supervision, and take the local and national conditions into consideration. |
