| 摘 要： | 西方各国优先权制度既有鲜明的个性特征,又有共同的演变趋势,无论是大陆法系还是英美法系,它们都根植于各国深厚的历史渊源和特定的国情基础。在通过对法国、德国、日本、英美等国的优先权制度理论和制度进行内在比较和研究的基础上,对我国优先权制度的建立提出了两点启示:建立统一的优先权制度是立法之趋;应坚持借鉴外国经验与本国国情相结合的原则。
