| 摘 要： | 法律是由语言表达的,语言是法律职业者开展工作和进行思考的前提与工具。法律语言从风格上看具有庄重性、确切性、平易简约性;从语汇上看具有单义性、特指性、社会性;从功能上看具有交流、转化、表达理性、价值贮藏的功能;从语义上看既具有确定性又具有不确定性,不确定性主要表现为法律语言的包容性、模糊性、动态流变性。立法中必须追求立法语境下的法律语义的确定性,司法实践中法律方法应实现法律语义由不确定性向确定性的转换。

| Abstract: | Words express the law.Words are the premise to law profesional engaged in legal research and legal application.Legal language is expected to have single and specific meaning,but legal semantics is vagueness and dynamic.Semantics is of certainty and uncertainty.Legislation pursues the certainty of legal language,but judicature is confronted with uncertainty.So legal method is expected to transform legal semantics from uncertainty to certainty. |
