晚近中国大陆死刑制度演进之观察——纪念韩忠谟先生百年诞辰

晚近30余年来中国大陆死刑制度历经初步限制、膨胀扩张和重新限制三个演进阶段,并以限制和减少死刑为主线,呈现出逐步废止死刑的渐进模式,其中各种主客观因素交相影响、制约,但始终坚持立法改革与司法改革并进且以司法改革为主的路径。未来中国大陆死刑制度演进与改革将继续延续该趋势,死刑适用的对象将进一步限缩,死刑罪名的数量将进一步减少,长期自由刑将逐步取代死刑,死刑的程序控制将更为严格,死刑的执行数量将进一步减少并逐步公开。

On the Evolvement of Death Penalty in Chinese Mainland in Recent 30 Years——In Memory of Han Zhongmo's 100-year-old's Birthday

Death penalty in Chinese Mainland comes through three phrases of primary restriction,expansion and new restriction in recent 30 years.During the process,the restriction and reduction of death penalty is always the main direction.Evolvement mode of death penalty is to gradually abolish death penalty that is decided by many key elements.Method of reformation is to combine legislation reformation with justice reformation,but justice reformation prior to legislation reformation.In future,the object scope of death penalty will be restricted more,the amount of death penalty in legislation will be lessened,and death penalty will be gradually substituted by long-term imprisonment and strictly restricted by procedure.The execution amount of death penalty will decrease more and be open to the public in near future.
