| 摘 要： | 作为刑事法治核心特征之一的"可预测性",在当下的中国刑法学界并未得到应有的关注.本文从形式理性的立场出发,对刑法视野中"理性预期"的价值蕴涵、理念贯彻、理论阈域等论题进行了探索性的初步考察.文章认为,自由与秩序是理性预期蕴涵的两大价值实体;要在刑法中贯彻理性预期这一理念,必须同时从原则、体系、运作等多个侧面全方位地予以落实;理性预测既非神话亦非万全,预测可能性能够获得,但却存在固有的边界.进而,文章就当下中国刑事法治建设对理性预期应持的姿态与立场进行了剖析,并提出了具体的贯彻策略.

| Abstract: | The predictability is one of the key features of the criminal law,but it has not been fully discussed.This paper intends to make a research on its values,implementation and limit.It is proposed that freedom and order are two important values of the rational predictability,which should be employed in the principle,the system and the operation.However,the rational predictability is not completely safe,but has its original limit.This paper further discusses the proper attitude and strategy towards the rational predictability in the construction of Chinese criminal law,and offers some detail suggestions. |
