论见义勇为的法律性质--兼论专门立法的不必要性

见义勇为事例的不断涌现给法律实践带来了一定的困惑,有些学者呼吁对见义勇为进行专门立法.实际上,现行法律中的正当防卫、紧急避险和无因管理制度足以调整见义勇为问题,当前各地纷纷成立的见义勇为基金会还在一定程度上弥补了现行法律在实践中的欠缺.解决见义勇为,不需要专门立法,而需要大力普法.

On the Legal Nature of Voluntarily Fighting against the Illegal: Also on the Un-necessity of its Special Legislation

The constant emergence of the cases of voluntarily fighting against the illegal has brought some puzzlement to the legal implementation and some scholars advocate its special legislation.The author of this paper holds that the existing items in the law like legitimate defense and avoiding the emergency as well as the system of impromptu management can help solve this problem.The relevant foundations emerging everywhere can somewhat compensate those involved.Thus,there is no need for enacting special laws but a need for popularizing the existing law.
