时代变革与制度重构:民事司法信息化的中国式图景

信息革命的辐射力逐步蔓延在我国民事司法领域,也预示着民事司法体系中的一场革命性变化。信息技术对民事司法体系的技术关怀,迎合了司法的效率化、技术化、精细化等倾向,形塑与培植着现代型民事司法制度。我国民事司法的信息化变革,蕴含了司法便民、司法效率、司法协商、司法公正等价值。面对信息化对现行民事司法体系的冲击,应当在坚持改革的合法性、程序适用的自愿性、灵活性与程序性相结合、兼顾公正与效率等原则的基础上,立足于信息化民事司法模式的启动方式、适用案件范围、审前程序规则、特殊审理规则、庭后工作规则等方面逐步实现信息化民事司法模式运作的制度化与法制化。

Times Change and System Reconstruction: China Type Picture of Civil Judicial Informatization

The radiation force of information revolution has gradually spread in China＇ s civil judicial field, signaling a revolutionary change in the system of civil justice. The technical care of information technology for the civil justice system caters to the tendency vating the civil judicial system of modem values as judicial convenience for people, of judicature efficiency, technology and refinement, shaping and cuhitype. The informatizing reform of Chinese civil justice contains such judicial efficiency, judicial consultation, and judicial justice etc. In terms of the impact of informatization on the current civil judicial system, it is suggested to adhere to the princi- ples of the legality of reform, the unity of voluntariness, flexibility and progress of procedure application, as well as the balance of justice and efficiency and so on. Meantime, the institutionalization and legalization of the oper- ation of informatizing civil judicial model can be realized from the standpoints of the launching ways, the scope of applicable cases, the pretrial procedural rules, the special trial rules and the work rules after court about the informatizing civil judicial mode.
