宪法精神人权化与构建和谐社会

“人权入宪”后,对什么是宪法精神,应当建立什么样的宪政,是理论界引起诸多争论中热点话题,本文首先评判了当前学术界关于宪法精神的论争,认为当代中国的宪法精神正在从国家本位向人权本位转化,并指出中国人权的本位转移为构建和谐社会提供理论基础,同时指出了现行宪法应当进一步改进之处,论证了“以人为本”、“人权至上”是当代宪法和构建和谐社会的最高原则。

The Humanization of Constitution Spirit and the Construction of Harmonious Societies
