| 摘 要： | 刑罚的必定性、及时性、相当性与经济性之所以能够被看成是刑罚的应然属性,乃是因为这些属性能够对刑法的真善美"高度"说明。而在基于刑法真善美所给予的"高度"说明中,刑罚的这些属性又展示了新的内容,并以刑法正义性包括人权正义与秩序正义为共同依归。

| Abstract: | The reason that the inevitability,timeliness, equivalence and economical efficiency of penah code can bereguarded as the due characteristics of it is that those characteristics can be highly illustrated in the true,the goodand beautiful of the criminal law. In the illustration for the crinimal law, those characteristics reveal their new con-tent, which comes to fairness of criminal law including fairness of human right and social order. |
