民事法官司法为民理念的认知、实践与传承——以模范法官工作法为演绎

在中国民事法官的司法实践中,涌现出了马锡五、宋鱼水、周春梅等一批司法为民的模范民事法官。为此,非常有必要分析出模范民事法官的工作方法。同时,从内涵剖析、思想渊源、理论基础等多视角解读司法为民。然而,新时期民事法官司法为民的实践带来了司法为民与违背民意、司法为民与故意不立案、司法为民与违法调解等方面的冲突与困惑。为此,从更新民事司法理念、抓好司法公正与高效、引进便民利民诉讼机制、走群众路线等方面寻求民事法官践行司法为民的路径。

In the judicial practice of civil judges in China, a group of model civil judges, such as Ma Xiwu, Song Yushui and Zhou Chunmei, have emerged. Therefore, it is very necessary to analyze the working methods of the model civil judges. At the same time, from the multi-perspectives of the connotation of analysis, ideological sources, theoretical basis etc. justice for the people is interpreted. However, in the new era, the practice of civil judge''s judicial service for the people has brought the conflicts and perplexities in the aspects of judicial service for the people and against the people''s will, judicial service for the people and willful omission of the case, judicial service for the people and illegal mediation. To this end, we seek ways for civil judges to practice justice for the people from such aspects as renewing the concept of civil justice, strengthening judicial justice and efficiency, purchasing litigation mechanism for the benefit of the people, and taking Mass Line action.
