| 摘 要： | 我国经济法责任"求新"、"求异"的研究进路,是基于论证经济法独立性的需要而阐释和展开的,它忽略了对传统法理学中"三大责任"、"四大责任"等分类方法的遵循和借鉴,难以指导经济诉讼实践.而在我国的经济诉讼实践中,经济法责任在借用传统法律责任的基础上,又具有新型法律责任的特点,其独特性体现在综合性、社会性和非对等性等方面.经济法责任形式主要包括民事责任、行政责任、刑事责任以及惩罚性赔偿、拆分企业等其他责任形式,且往往具有独立的或相对独立的执法机构.因此,合理化的经济法责任研究应回归法理学层面的法律责任理论,并在经济诉讼实践中归纳和提炼其具体形态,方能实现理论上的通达与自洽.
