| 摘 要： | 对物诉讼是一种在国际上通行的法律制度,但我国在相当时期内并没有接受,<海事诉讼特别程序法>的出台改变了这种状况,在实质上认可了这种制度.本文结合海事司法实践和国际立法动向,分析了这种制度在<海事诉讼特别程序法>中的具体表现.

| Abstract: | Action in rem,an internationally ac cepted system,had not been admitted in China until the issue of the Mariti me Procedure Law(MPL),which approbates it substantively.This paper tries to probe into the fu nction of this system in MPL in the background of maritime j uridical practice and international legislation tide. |
