| 摘 要： | 《周礼.地官.媒氏》所载是目前所见中国古代最早的婚姻立法,从婚姻年龄、登记管理、促婚政策、聘礼数额、以及婚姻诉讼等五个方面对婚姻制度进行了较为全面的规范,与后世婚姻法律相比,虽然还有很多细节不够周全,但可以说从整体框架上奠定了中国古代婚姻立法的基础。其他先秦文献都无法与之相比。近二三十年来出土的简牍资料证明,《媒氏》所载基本上属于战国时期的婚姻法规。

| Abstract: | Chou Rite·Diguan· Meishi is the earliest marriage legislation in ancient China.It is relatively standard in the following five aspects： marriage age,registration and management,promote marriage policy,the dowry amount,and matrimonial proceedings.Though there were many details not well compared with nowadays marriage laws,it laid the foundation of ancient Chinese marriage legislation from the whole framework.Other pre-qin literature can＇t be compared with it.Recent years slips unearthed demonstrate that the marriage regulations in Meishi basically belong to the warring states period. |
