环境侵权冲突法的发展及其对中国立法的影响

20世纪后期，国际上出现对涉外环境侵权制定特殊冲突规则的立法动向，在立法内容上显现出保护受害人利益的倾向，这是对传统侵权冲突法的一种突破。2002年提交全国人大审议的《中华人民共和国民法（草案）》第9编在其影响下就环境侵权的法律适用也做出特别规定，这是立法意识上的进步，但在具体制度设计上还需进一步完善。
